Introduction
These Terms and Conditions apply to all services provided by SK Design Media and through the website SallyKamara.com. By requesting a quotation, approving a proposal, making payment or working with SK Design Media, the client agrees to be legally bound by these Terms and Conditions.
SK Design Media is a London-based creative digital business specialising in strategic website design, WordPress website development, branding, website redesign, digital strategy, website maintenance and digital content support for businesses, professionals and organisations seeking a professional online presence. These Terms and Conditions are designed to create a professional, transparent and fair working relationship between SK Design Media and its clients.
Project Acceptance
All projects are accepted at the discretion of SK Design Media. Work will only begin once the client has approved the quotation, invoice or proposal, the required deposit has been received and the necessary project information has been provided. SK Design Media reserves the right to refuse, pause or terminate any project considered unlawful, inappropriate, misleading, abusive or outside the services offered by the business.
Client Responsibilities
The client is responsible for providing all required content, images, logos, login details, documents, business information and materials required for the project. Clients are expected to communicate professionally, provide clear instructions and respond to requests for information or approvals within a reasonable timeframe.
By supplying content to SK Design Media, the client confirms that they own the content or have full legal permission to use it. The client accepts full legal responsibility for any copyright infringement, trademark infringement, copied material, misleading claims or legal disputes connected to the information or materials they provide. SK Design Media will not be held legally responsible for claims, disputes, penalties or losses arising from client-supplied content, images, documents or information.
Scope of Work
The scope of work for each project will be outlined within the agreed quotation, invoice, proposal or selected package. The work carried out by SK Design Media depends on the nature, complexity and requirements of the project rather than a fixed hourly rate structure.
Any additional requests outside the original agreed scope, including extra pages, redesigns, advanced functionality, integrations, additional content uploads, restructuring, revisions outside allowance or new features, may result in additional charges. Any additional work will always be discussed and agreed before work proceeds.
Website training sessions are not automatically included within every package. Clients investing in higher-level projects from £2500 and above may receive a complimentary training session where applicable as part of their selected package. Clients on lower-tier packages who require training, website guidance or additional support sessions after handover will be charged separately at a rate of £50 per hour.
Website Packages, Revisions and Support
SK Design Media currently offers the Foundation, Authority and Organisation packages. Each package is structured differently based on the scale, complexity and strategic requirements of the project. The level of services, support period, revision allowance and additional features included within a project depend entirely on the package selected by the client at the time of booking or payment made. Higher-level packages may include additional strategic planning, integrations, extended support and training sessions where applicable.
The number of revision rounds included within a project is determined by the selected package and agreed quotation. Revision rounds are intended to refine and improve the agreed design direction and do not include complete redesigns, entirely new concepts or major structural changes after approval has been given.
Once the included revision allowance has been used, any further revisions, redesign requests or additional changes outside the original project scope may result in additional charges. Project timelines will vary depending on the complexity of the project, technical requirements, client responsiveness, content delivery and selected package. Any timeline provided by SK Design Media is an estimate only and may change where delays occur outside reasonable control.
Payments and Deposits
A 75% upfront deposit is required before any work begins unless otherwise agreed in writing by SK Design Media. The remaining balance must be paid before the website is launched, transferred or officially handed over to the client.
For organisation, corporate or higher-value projects, the required 75% deposit must be received before work can commence unless the client chooses to make full payment upfront at the beginning of the project. SK Design Media reserves the right to pause work, delay launch, suspend services or withhold project deliverables where outstanding balances remain unpaid.
Refund Policy
Refund requests are only considered within 24 to 48 hours of payment and apply only to clients investing £2500 or above, provided that work has not yet started on the project. Once work has commenced, refunds will no longer apply regardless of the project value or payment amount. This includes strategy work, consultations, planning, branding, website setup, design work, development work, revisions, content uploads and technical setup already carried out by SK Design Media.
Refunds do not apply to completed work, approved designs, revision requests, concepts, mock-ups, consultations or customised services already delivered. Where refunds are approved before work has started, processing times may take between 3 to 7 business days depending on the payment provider or bank.
Where a refund is approved, SK Design Media reserves the right to deduct a reasonable administrative and processing fee to cover work already completed, transaction charges, consultation time, planning, communication, setup work and other business-related costs incurred before cancellation. The amount deducted will depend on the stage of the project and services already provided.
This may include, but is not limited to:
- consultation and discovery work
- project planning and research
- administrative and communication time
- payment processing or transaction fees
- partial design or development work already completed
- content preparation or setup tasks
Any remaining eligible refund amount will be processed after these deductions have been made.
Project Timelines and Delays
Project timelines are estimates based on the agreed scope of work, package selected, client responsiveness and content delivery. SK Design Media will not be held responsible for delays caused by late client responses, delayed content delivery, third-party providers, hosting companies, software issues or circumstances outside reasonable control. Projects left inactive for extended periods due to lack of client communication may be paused, archived or closed.
Website Maintenance and Support
Once a website has been completed, launched and officially handed over to the client, SK Design Media will no longer be responsible for the ongoing management, maintenance, security, performance, functionality or monitoring of the website unless an agreed website care plan or maintenance agreement has been put in place and active monthly payments are being maintained by the client.
Following launch, clients may receive a limited free support period depending on the selected package. This support period is intended only for basic edits, small adjustments and general guidance relating to the completed website. Technical work, advanced troubleshooting, malware removal, plugin conflicts, software errors, redesign requests, adding content, website recovery, hosting issues, security management or major modifications are not included within the free support period unless covered under an active paid website care plan.
Any ongoing website maintenance, technical support, troubleshooting, plugin updates, monitoring, backups, security management or advanced assistance required after handover will only be provided through an active paid care plan or maintenance agreement. SK Design Media will not be held responsible for website downtime, hacking, malware, plugin failures, software conflicts, expired services, hosting problems, technical faults, data loss or website damage occurring after handover where no active care plan or maintenance agreement is in place.
Hosting, Domains and Renewals
Hosting, domain registration, SSL certificates and related third-party services remain the responsibility of the client unless otherwise agreed in writing. Failure to renew hosting, domains or related services may result in website downtime, removal, email interruption or data loss. SK Design Media is not responsible for losses caused by expired or unpaid services. If a client chooses not to continue with hosting or maintenance services, SK Design Media is under no obligation to continue paying for or maintaining the client’s website, hosting or domain.
Portfolio and Promotional Rights
SK Design Media reserves the right to display completed work within its portfolio, website, social media platforms, YouTube content, presentations and promotional materials. This may include screenshots, branding visuals, graphics, website walkthrough videos, portfolio case studies and screen recordings used for marketing or educational purposes. If a client does not wish for their project to be publicly showcased, they must notify SK Design Media in writing before or during or after the project.
Third-Party Platforms and Services
Some services may involve third-party platforms including WordPress, Google, Meta, Canva, Adobe, YouTube, hosting companies, payment processors, plugin developers or domain providers. SK Design Media is not responsible for outages, policy changes, suspensions, technical failures, security breaches or interruptions caused by third-party services or platforms.
SEO and Marketing Disclaimer
While SK Design Media may provide SEO setup, optimisation guidance or digital marketing support, no guarantees are made regarding search engine rankings, website traffic, enquiries, conversions, sales or business growth. Results depend on many external factors including competition, consistency, market conditions, search engine algorithms and client activity and adding content to the website.
Intellectual Property Rights
Upon full payment, ownership of the completed final website and approved design work transfers to the client. Until full payment has been received, all drafts, mock-ups, concepts, layouts and unfinished work remain the property of SK Design Media. SK Design Media reserves the right to use completed work within its portfolio and promotional materials unless otherwise agreed in writing.
Suspension and Termination
SK Design Media reserves the right to suspend or terminate services where payments remain unpaid, communication becomes abusive or unreasonable, project requirements change significantly outside the agreed scope or the client breaches these Terms and Conditions. Where termination occurs due to client breach, completed work and time already spent remain chargeable and non-refundable.
Disclaimer of Warranties
All services are provided on an “as is” basis. While SK Design Media aims to deliver professional and high-quality services, no guarantees are made that websites, systems or third-party services will always operate without interruption, errors or security risks. SK Design Media is not liable for technical failures, cyber attacks, downtime, hosting issues, software conflicts or external service interruptions outside reasonable control.
Limitation of Liability
SK Design Media will not be liable for indirect, incidental or consequential losses including loss of income, business interruption, loss of rankings, downtime, data loss or damages resulting from third-party services or client negligence. The total liability of SK Design Media relating to any project or service shall not exceed the amount paid by the client for the specific project in question.
Changes to Terms and Conditions
SK Design Media reserves the right to update or modify these Terms and Conditions at any time. Continued use of the website or services after updates are published means the client accepts the revised Terms and Conditions.
Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Any disputes relating to services provided by SK Design Media shall be handled under UK jurisdiction.
